Terms of service

These Terms of service ("Terms") govern your access to and use of Vukosi, including all applications, websites, features, content, and services we provide ("Service"). By creating an account or using Vukosi, you agree to be bound by these Terms.

Vukosi is available only in South Africa. If you reside outside South Africa, you may not use the Service. If you do not agree to these Terms, you must stop using Vukosi.

To use Vukosi, you must:

• Be at least 16 years old;
• Live in South Africa;
• Have legal capacity to enter into an agreement;
• Not be prohibited from using the Service under South African law.

If you are under 18, a parent or legal guardian must review these Terms with you.

3.1 Account creation

You must provide accurate information when creating an account, including your name and username.

You may not:

• Provide false information;
• Create an account for another person without permission;
• Use someone else’s identity;
• Create or operate parody or fan accounts;
• Create more than one personal account unless authorised.

3.2 Account security

You are responsible for safeguarding your login credentials. Notify us immediately if you believe your account has been accessed without permission. We are not liable for losses caused by failure to secure your account.

3.3 Account status

We may limit, suspend, or terminate your account if you violate these Terms, our Privacy policy, or our Community guidelines.

4.1 Ownership

You retain full ownership of the photos, videos, captions, comments, and other material you post ("Content").

4.2 Licence to Vukosi

By posting Content, you grant Vukosi a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, use, reproduce, distribute, modify, publicly perform, publicly display, translate, and create derivative works from your Content solely for purposes of operating, developing, promoting, and protecting the Service.

Vukosi may introduce revenue sharing or monetisation programs in the future, which may allow creators to earn from their Content subject to additional terms and eligibility requirements. Participation in such programs will be optional and governed by separate agreements.

This licence ends when your Content is deleted, except that Content already shared with other users may remain visible and backup copies may remain for a limited time.

4.3 Responsibility

You are solely responsible for your Content. You must not upload anything that violates our Community guidelines or the laws of South Africa.

You agree not to:

• Break or bypass security measures;
• Use automated tools to scrape or collect data;
• Copy, distribute, or sell any part of the Service without permission;
• Upload malware, viruses, or harmful code;
• Interrupt or degrade the performance of the Service.

The following are strictly prohibited:

• Harassment, bullying, or threatening behaviour;
• Hate speech, racial discrimination, or inciting violence;
• Sexual exploitation or sexually inappropriate content involving adults or minors;
• Graphic violence or celebrating harm;
• Impersonation of celebrities, politicians, brands, or public figures;
• Posting illegal content, including drugs, weapons, or criminal activity;
• Encouraging harm, including dangerous challenges or harmful behaviour.

Violation of these rules may lead to immediate suspension.

You may report posts, stories, comments, replies, or accounts that violate our policies. We may remove or restrict Content; add warnings or sensitive-content screens; suspend or terminate accounts; and cooperate with law enforcement if required by law.

Vukosi moderates Content using automated tools and human review. However, we cannot guarantee immediate action on all reports.

We may update, modify, or discontinue some features at any time. We are not liable for any loss resulting from these changes.

You may deactivate your account (reversible for 30 days) or delete your account (permanent after 30 days). Some information may remain in backups for a limited period or as required by law.

Some features may rely on third-party services or integrations. Your use of those services is subject to their terms and policies. We are not responsible for third-party actions.

All trademarks, logos, branding, design elements, and software associated with Vukosi belong to us. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

To the maximum extent permitted by South African law, Vukosi is not liable for loss of data; damages arising from Content posted by users; service interruptions or technical errors; losses caused by hacked or compromised accounts; or harms arising from reliance on Content posted on the Service. The Service is provided “as is” without warranties.

You agree to indemnify and hold harmless Vukosi against claims, damages, losses, liabilities, or expenses arising from your use of the Service or your violation of these Terms.

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be resolved in South African courts.
